Terms of Service for Bror

- Agreement to Terms
By accessing or using Bror (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the App.
- Description of Service
Bror is a ride-hailing platform that connects riders with independent drivers. Bror acts as a technology platform and does not provide transportation services. All transportation services are provided by independent third-party drivers.
- Eligibility
3.1 General Requirements
- You must be at least 18 years of age
- You must have the legal capacity to enter into binding agreements
- You must provide accurate and complete information
- Your account may not be used by any other person
3.2 Additional Driver Requirements
To drive on the platform, you must:
- Have a valid driver’s license
- Have valid vehicle registration and insurance
- Pass a background check (if required by local regulations)
- Meet any additional local regulatory requirements
- User Accounts
4.1 Account Creation
- You must create an account to use the App
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities under your account
- You must notify us immediately of any unauthorized access
4.2 Account Types
- Rider Account: For requesting rides
- Driver Account: For providing rides (subject to approval)
- You may maintain both account types with proper verification
- Use of the Service
5.1 Permitted Use
You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Engage in fraudulent activities
- Harass, abuse, or harm other users
- Transmit viruses or malicious code
- Attempt to gain unauthorized access to the system
- Use the service for any commercial purpose without authorization
- Interfere with or disrupt the service
5.2 Rider Responsibilities
- Provide accurate pickup and drop-off locations
- Be ready at the pickup location at the scheduled time
- Treat drivers with respect and courtesy
- Pay all applicable fares and fees
- Not transport illegal goods or substances
- Follow driver instructions regarding vehicle use
5.3 Driver Responsibilities
- Maintain valid licenses, insurance, and vehicle registration
- Maintain vehicle in safe, clean condition
- Drive safely and obey all traffic laws
- Treat riders with respect and courtesy
- Complete accepted rides in a timely manner
- Not discriminate against riders
- Be available and responsive during accepted rides
- Payments and Fees
6.1 Pricing
- Fares are calculated based on distance, time, and demand
- Pricing may vary based on location and time of day
- You will see estimated fare before confirming a ride
- Final fare may differ from estimate due to route changes or wait time
6.2 Payment Methods
- Riders must provide a valid payment method
- Payment is automatically charged after ride completion
- Drivers receive payment through our platform (minus service fees)
6.3 Cancellation Fees
- Cancellations may incur fees as displayed in the app
- Fees compensate drivers for time and effort
6.4 Driver Earnings
- Drivers earn fares minus platform service fees
- Service fee structure is disclosed in the driver app
- Drivers are responsible for applicable taxes on earnings
- Ratings and Reviews
- Both riders and drivers can rate each other after trips
- Ratings should be honest and based on actual experience
- Low ratings may result in account review or suspension
- We reserve the right to remove inappropriate reviews
- Cancellations and Refunds
8.1 Rider Cancellations
- Riders may cancel before driver acceptance without penalty
- Cancellations after acceptance may incur fees
8.2 Driver Cancellations
- Drivers should only cancel for legitimate reasons
- Excessive cancellations may affect driver standing
8.3 Refunds
- Refunds are issued at our discretion
- Dispute fare issues through the support system
- Refund processing may take 5-10 business days
- Safety and Security
9.1 Emergency Situations
- In case of emergency, contact local authorities first (911, etc.)
- Report safety incidents through the app immediately
- We cooperate with law enforcement when legally required
9.2 Insurance
- Drivers must maintain appropriate insurance coverage
- Bror does not provide insurance for rides
- Check with your insurance provider about ride-sharing coverage
- Intellectual Property
- All content, trademarks, and intellectual property belong to Bror or its licensors
- You may not use our trademarks without permission
- You grant us a license to use content you submit (profile photos, reviews, etc.)
- Privacy
Your use of the App is also governed by our Privacy Policy. We collect and use your information as described in the Privacy Policy, including location data necessary to provide ride services.
- Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:
- Uninterrupted or error-free service
- Availability of drivers at all times
- Accuracy of ETAs or route information
- Quality or safety of transportation provided by drivers
- Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROR SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Actions or omissions of drivers or riders
- Accidents, injuries, or property damage during rides
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS.
- Indemnification
You agree to indemnify and hold harmless Bror from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your use of the service
- Your violation of any rights of others
- Your actions as a driver or rider
- Account Suspension and Termination
15.1 By Bror
We may suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activities
- Low ratings or negative feedback
- Safety concerns
- Any other reason at our discretion
15.2 By You
You may terminate your account at any time through the app settings. Outstanding payments must be settled before account deletion.
- Dispute Resolution
16.1 Informal Resolution
Please contact our support team first to resolve any disputes.
16.2 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration, except where prohibited by law.
16.3 Class Action Waiver
You agree to resolve disputes on an individual basis and waive the right to participate in class actions.
- Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.
- Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
